options for when an exclusive contract expires

Greetings all,

I’m looking at a few exclusive library contracts (from non-ex who want ex) – they will have the tracks exclusively for periods of one or three years. Then if I choose, I can “have them back.”

I want to be sure I’m keeping my word so here’s my question: if at the end the contract term I’ve seen no/low income from a particular track(s) but have an opportunity to place that track into another exclusive contract, is that track still exclusive since the second library won’t be the only source for that track – assuming that the track from the first library
is still in a TV being aired?

So can that track still be considered exclusive?
