    The tax form you need to submit to the Italian publisher/library is the W-8BEN form. This form is a certificate of foreign status that allows you to claim a reduced rate of withholding on your Italian royalties. The W-8BEN form is available on the IRS website.

    To complete the W-8BEN form, you will need to provide your name, address, taxpayer identification number (TIN), and country of residence. You will also need to check the box that indicates that you are a resident of the United States and that you are not subject to Italian taxation on your Italian royalties.

    Once you have completed the W-8BEN form, you should send it to the Italian publisher/library. You can also send the form to the IRS, but this is not required.

    Here are the steps on how to submit the W-8BEN form to avoid double taxation of 30%:

    Go to the IRS website and download the W-8BEN form.
    Complete the form and sign it.
    Send the form to the Italian publisher/library.
    Keep a copy of the form for your records.

    I’d venture to say your situation is markedly different than most composers here. I do know I am not the only on MLR who has had the same experience with AdRev versus Identifyy.

    As far as the other questions you asked both AdRev and Identifyy had basically the same catalog and metadata.

    I have had no problems with customer service on Identifyy. A bit slow at times but nothing critical.

    Money-wise, ballpark, about 10 to 1. I didn’t get too far into the weeds with this as I am happy I made the switch. YMMV.

    Not true in my case. Identifyy paid much, much better than Adrev.

    Sounds like you need an attorney who specializes in licensing.

    But, my two pennies worth.

    As far as YouTube Content ID goes you could just collect the royalties and not issue Copyright strikes. That’s generally what Identifyy does and could be very lucrative.

    I would not give up the the Copyright on the new piece. I would give them an exclusive license, for a fee, for x number of years, on just the game. You could renegotiate for a new term as you approach the end of the first term. The success of the game might determine what those terms might be.

    As for broadcast rights: You would still get paid as writer and publisher as long as you did not opt to sell them the Copyright.

    I’m not a lawyer and, again, just my two cents worth.

    @BobBallard. It’s not really a problem. Identifyy just quietly collects the royalties and does not, usually, issue takedowns unless requested. We have hundreds of videos detected and never had an issue with a client copyright strike. That was more of a problem a few years ago. All of our music is non-exclusive.

    @BobBallard. I would imagine those libraries want to collect any royalties for themselves. I would not put that music in Identifyy. This is my opinion and I’m willing to be proven wrong. 🙂

    @DavidM If they are exclusive to other libraries, I would think it might be a problem unless you are designating, to Soundmouse, that the exclusive library is the publisher.
